“Terms and Conditions”
We appreciate that you have visited our digital news network newsparagon.com. Please read these guidelines thoroughly before using our network. You can get it in a variety of ways, including newsparagon.com on the web, digital TV, a PDA, a cell phone, or RSS feeds. In these terms and conditions, ” Site” or “our site” refers to the digital information network operated by or for News & Media Limited, its parent companies, subsidiaries, and affiliates (collectively “Paragon”). This includes, but is not limited to any other domains, websites, or apps owned or operated by paragon, as well as other content that may be updated on a regular basis. You agree to obey these terms anytime you visit the News Paragon Site, whether via a third-party site, app, link, or other means.
You should carefully read all of these terms and conditions, but pay special attention to sections 3 and 12: section 3 is about how you can use content on the paragon Site; section 4 is about how we don’t accept any responsibility for anything you do; section 6 is about the content you send us; and section 12 is about how you agree to pay us if you break these terms and conditions.
You also agree to be bound by the extra terms at the end of these terms and conditions if you came to the paragon Site from the United States or Australia.
We may cancel or limit your access to all or part of the Paragon Site right away and without warning if we think for any reason that you have not followed these terms and conditions.
For Registration
By becoming a registered member and making an account with us, you can get to parts of the Paragon Site that require registration. You agree to be responsible for keeping your passwords and other account information secret, as well as for anything that happens under your account.
You agree to these terms when you sign up for the Paragon Site:
i. No one else can use your account or password to get into the Paragon Site and use your account;
ii. You won’t do anything that would make it easier for someone who isn’t a registered user to get into any part of the Paragon Site that is for registered users; and
iii. It is understood that you will not make login accounts to abuse the Paragon Site or other users, and you will also not try to pretend to be someone else.
You agree to let us know right away if you find out that someone else has used your password or account information without your permission.
Taking down the Registration
You can delete your account by going to your account settings and clicking on “delete account.” Doing this will remove your registered account. Please keep in mind that you won’t be able to delete your account online automatically if you subscribe, become a member, or make a donation that charges us regularly. If you still want to delete your account, please follow the steps given on the page that lets you do so and try again. If not, please get in touch with us using the information for your area that you can find in the help center.
You must stop using the Paragon Site if you don’t agree with these terms and conditions or any changes made to them in the future. If you keep using the Paragon Site, that means you agree to these terms and conditions.
We can close your registered account at any time by sending you an email at the address you provided letting you know that the agreement has ended.
Using things that are on the Paragon Site
You agree that Paragon owns or has permission to use all content on the Paragon Site, excluding user content and ads (which we will talk about below). This includes all copyrights, patents, trademarks, trade secrets, trade names, logos, and other intellectual property rights related to the Paragon Site, as well as all text, images, graphics, logos, audio, video, URLs, metadata, and other content that appears on the Paragon Site (“Paragon Content”). Copyright rules and other intellectual property laws in the UK, the US, and Australia protect the Paragon Site and the Content. International copyright treaties also protect these things around the world.
You may only use the Paragon Site and Paragon Content for your own personal, non-business needs. You can only download and print parts of the Paragon Content for your own personal, non-commercial use. You must also keep and follow any author credit, copyright or trademark notices or restrictions in the material you download or print.
You may not use the Paragon Site or any Content (including any metadata like keywords, captions, or other related information) for any other reason without our written permission first. This includes not using, copying, scraping, reproducing, altering, collecting, mining, or extracting the Paragon Content for (a) machine learning, artificial intelligence, or language models related purposes (such as training or developing these technologies); (b) text and data gathering, analysis, or mining purposes (such as to find patterns, trends, or correlations); or (c) with machine learning and/or artificial intelligence technologies to create any data or content or to synthesize or combine with other data or content; or (d) for any commercial use.
You may not use, help, authorize, or let anyone else use any (i) “robot,” “bot,” “spider,” “scraper,” “crawler,” or (ii) other automated device, program, technique, tool, process, algorithm, or method (whether for data gathering, mining, collection, reading, scraping, extraction, or other purposes) on or in relation to the Paragon Site and/or the Paragon Content unless these terms and conditions say so or unless the Paragon says otherwise in writing.
You can’t use any service, software, device, tool, method, program, technique, algorithm, or process to get around any rule, condition, protection, or technological measure that limits access to the Paragon Content. This includes getting around any access controls or use limits of the Paragon Content, such as robots.txt internet protocols or similar or successor protocols.
To be clear, the Paragon holds all rights to the Paragon Content, as long as they are legal. This includes the rights set out in Article 4(3) of Directive (EU) 2019/790, which amends Directives 96/9/EC and 2001/29/EC and covers copyright and related rights in the digital single market. The Paragon also holds similar rights in other places, but only to the extent that the law allows.
Not taking Responsibility
We accept no responsibility for anything said in the Paragon Content to the extent permitted by law. The Paragon Content is not provided for any specific cause or at the request of any particular individual. So there is no question that we will not be liable for any injury you suffer as a result of what you do or do not do after viewing, reading, or listening to any of the Paragon Content. The Paragon Site contains links to other websites that you can utilize. We have no control over these websites, thus we are not responsible for anything that appears on them.
We don’t promise anything about the Paragon Site or the Paragon Content. One thing we don’t promise is that the Paragon Site or any of its material is virus-free. You need to be careful in this area because we are not responsible for any attack by virus or other harmful things.
We will try our best to make sure that you can always view the Paragon Site, but we can’t promise that it will always be available. There is no duty or liability on our part for any unavailability, interruption, or delay.
If you are in the US or Australia and visiting the Paragon Site, the extra disclaimers and limits of responsibility in Sections 14 and up will apply.
Advertisement from outside sources on the Paragon site
Advertisements sent in by outsiders will show up on the Paragon Site. It is up to each seller to decide what is in their own advertising materials. We are not responsible for the advertising material’s content, including any mistakes, omissions, or false information that may be in it.
Use this online form to get in touch with the sales team if you want to put an ad on the Paragon Site. The Paragon is the only company that sells ads directly on the Paragon Site. Aside from third parties that the Paragon approves from time to time, you may not deal with any other third parties about the sale and placement of ads on the Paragon Site.
What users write
People who use our site might be able to send in content that will be published in different parts of the Paragon Site. Our Community Standards and Participation Guidelines, which you can find at newsparagon.com/community-standards, control how you can use our site. They are also a part of these terms and conditions. It is assumed that you agree to these rules and terms and conditions if you post anything or leave a message on the Paragon Site.
When you send us content, you both agree and promise that you either made it yourself or have permission from the owner of any part of the content to send it to the Paragon Site.
Copyright
Copyright in the content you send us still belongs to you or the owner of the content. However, by sending it to us, you give us an unrestricted, perpetual, worldwide, fully transferable, non-exclusive, royalty-free license to use, publish, and/or transmit it, and to allow others to use, publish, and/or transmit it in any format and on any platform, whether they are known now or in the future.
You understand and agree that when you post content on the Paragon Site or read other people’s content, you do so at your own risk, including any reliance on the truth or completeness of that content. You also understand and agree that the opinions shared by you and other users in that content do not always represent the opinions of Paragon, and that we do not support or endorse any user content. You agree that we are not required to pre-screen, monitor, review, or change any information that you or other users post on the Paragon Site.
We or authorized third parties can choose not to post your content or cut, crop, edit it or refuse to do so at any time. We can stop using your work whenever we want.
We’re not responsible for any information posted by users that is then shared by us or authorized third parties.
You understand that the technical processing and sending of the Paragon Site may include (i) sending it over multiple networks and (ii) changing content to fit the needs of the devices or networks that are connecting. Paragon will not be held responsible if they delete or fail to store material or other information that you or other Paragon Site users post.
If you are younger than 16, you promise that your parent or Paragon has given you permission to post content.
No Help
The content of any media is only meant to be general knowledge. It’s not advice, and you shouldn’t use it instead of personalized help that takes your health, finances, or other situation into account.
Having intellectual property
News or its licensors, advertisers, or affiliates own all intellectual property rights to material on any of the Media. You don’t get any rights to that intellectual property. All of the Media’s material is protected by copyright and other intellectual property laws in Australia and around the world. It is against the law for you to do anything that breaks those rules or the intellectual property rights in the content.
If you want to use something on any of the Media for personal, non-business reasons, you can download it, watch it, or print a copy of it, but you can’t change anything about it (including any copyright notices). News holds all rights that aren’t clearly given away in these terms of use. You may not copy or republish anything you find on any of the Media without the permission of the owners of the rights or trademarks, unless it says otherwise.
The names of the media are registered trademarks of News or the companies that work with it. From time to time, other logos may be shown on the Media. These might belong to other people. Without the written permission of the rightful owner, nothing on the Media should be taken as giving a license or right to use any logo, trademark, or masthead that is shown on the Media.
Responsibility and liability
News does not take away any rights and remedies that people have in relation to goods or services under the Australian Consumer Law in the Competition and Consumer Act 2010 (ACL) or similar laws in other states or territories. These rights and remedies cannot be taken away, limited, or changed. As long as the law lets them, News doesn’t give you any rights, remedies, promises, conditions, or warranties about goods or services that come from using any of the Media. This includes rights that come from statutes, common law, or anything else. The following rules apply to the fullest extent allowed by law, as long as News doesn’t break any of its duties or liabilities under the ACL:
News doesn’t promise that the information you get from any of the Media is correct. You are given the material “as is” and “as available,” and you use it at your own risk. All the material you see on any of the Media can be changed at any time and for any reason by News.
If you lose something or damage your software or hardware because you used or accessed any of the Media, News is not responsible or liable. This includes if the loss or damage was not caused by News’s carelessness, willful misconduct, or fraud.
News doesn’t promise that functions of the Media or content you access through any of the Media, like hyperlinks, will work perfectly or without errors, that bugs or other issues will be fixed, that technical issues won’t stop or delay the delivery of any of the Media or content that should be accessible through any of the Media, or that News or the server that makes it available is bug- or virus-free.
There are times when state laws, like the ACL, let News off the hook for breaking an implied term or condition. If they do, News can choose to either provide the service again or pay to have it provided again. News can’t limit its responsibility in this way, though, if you can show that it wouldn’t be fair or reasonable for News to do so.
